GENERAL CONDITIONS OF SALE

1. Premise

The website www.petwellnessandlifestyle.com (hereinafter the “Site”) is owned by Zaira P Giulianelli, with registered office in Via Torricelli 7, 60019 Senigallia (AN), IT – P.IVA 02812990428.

Through the Site, the Seller offers for sale products and/or services (hereinafter the “Products” or “Services”), which may include physical goods, digital guides, downloadable resources, and memberships.

These General Conditions of Sale (the “General Conditions”) govern the remote purchase of Products and Services through the Site, in compliance with Italian law.

The person who accesses the Site to make purchases (the “Customer”) is required, before proceeding with the purchases, to carefully read and accept these General Conditions, by accessing the relevant page of the Site where they are published.

Sales through the Site are exclusively reserved to the consumer Customer pursuant to art. 3 of the Consumer Code (Legislative Decree 6 September 2005, n. 206), that is “the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.”

To purchase through the Site, the Customer must be at least eighteen years of age.


2. Choice and Order of Products / Services

The main characteristics of each Product or Service (e.g. content, variants, format, access mode, price, etc.) are indicated in the respective description sheet on the Site. For physical products, graphic representations are provided for illustrative purposes; for digital products and memberships, descriptions and previews are indicative only.

Each Customer may purchase Products/Services by registering on the Site (the “Registered Customer”), or as a guest without registering (the “Unregistered Customer”).

In all cases, the Customer must provide a valid email address when completing the order. This is necessary both for processing the purchase (e.g. confirmations, access links, invoices) and for inclusion in the Seller’s communication and support system, which is an integral part of the purchase process. If the Customer fails to provide a valid and functioning email address, the Order cannot be completed.

After sending the Order:

The Customer will receive an email confirmation containing the Order number, the list of Products/Services purchased with their essential characteristics, and the total price including any applicable delivery costs.

The Seller will verify availability and correctness of the information provided and:
i) if the Products/Services are available and information correct, the Order will be processed;
ii) if not available or information incorrect, the Order will be cancelled;
iii) if only part of the Order is available, it will be processed for that part only.

For digital Products and memberships, access is considered delivered at the time the Customer receives the download link, access credentials, or confirmation of subscription via email.


3. Prices and Delivery Costs

All prices are expressed in Euros and include VAT.

For physical products, delivery costs (the “Shipping Costs”) are charged to the Customer and indicated before placing the Order.
For digital Products and Services, no shipping costs apply.


4. Methods of Payment

The Customer may pay the price of the Products/Services and any Shipping Costs by:

Credit or debit card (Visa, MasterCard, American Express, Maestro)

PayPal

The Site does not store the Customer’s credit or debit card data.

For PayPal, the Customer will be redirected to the PayPal site where payment can be made through their account or accepted card.


5. Right of Withdrawal

5.1 Physical Products
The Customer has the right to withdraw from the purchase within 14 days from delivery, without giving reasons, in accordance with Articles 52 and following of the Consumer Code. To exercise the right of withdrawal, the Customer must notify the Seller by email at [email protected]. The costs of returning the Product are borne by the Customer. Refunds will be made within 14 days of receiving the returned goods, using the same means of payment used for the purchase.

5.2 Digital Products and Services
In accordance with Article 59 of the Consumer Code, the right of withdrawal does not apply to digital content supplied electronically once the download or access has begun, if the Customer has expressly agreed to the execution starting immediately and acknowledged that they would lose their right of withdrawal.


6. Legal Guarantees for the Customer

For physical Products, the Customer benefits from the legal guarantee provided by Articles 128 to 132 of the Consumer Code in case of defects.

For digital Products and memberships, given their nature:

Once accessed or downloaded, they cannot be returned or refunded.

In case of technical problems preventing access to purchased content, the Customer must notify the Seller immediately by email to [email protected]. The Seller will restore access or provide a valid replacement where possible.

Products or digital services altered, misused, or shared in violation of copyright are excluded from the guarantee.


7. Errors and Limitations of Liability

Information on the Site is constantly updated; however, errors may occur. The Seller reserves the right to correct errors or update information at any time without prior notice, without prejudice to the Customer’s rights under applicable law.

Except in cases of willful misconduct or gross negligence, the Seller excludes any liability for direct or indirect damages resulting from use of the Site, non-acceptance of an Order, or improper use of Products/Services.


8. Complaints

Any complaint must be sent by email to: [email protected].


9. Intellectual Property

All trademarks, names, logos, images, texts, and content available on the Site or relating to the Products/Services remain the exclusive property of Zaira Giulianelli and/or her assignees.

The Customer has no rights over such content and may not reproduce, transfer, modify, or use it for purposes other than personal use without prior written consent.


10. Processing of Personal Data

The Customer’s data is processed by the Seller in compliance with applicable data protection laws (including GDPR), as specified in the Privacy Policy section of the Site.

By providing their email address during purchase, the Customer:

Consents to receive all necessary transactional communications (order confirmations, invoices, access credentials, updates, customer support).

Acknowledges that their email may also be used to send relevant follow-up communications, updates, and offers related to the purchased Products/Services, as part of the Seller’s customer relationship and loyalty program.

The Customer may unsubscribe from non-transactional communications at any time via the unsubscribe link contained in each email or by contacting the Seller.
